Terms of Service
Welcome to ITSC GROUP G-TELP Service. These Terms of Service, along with our Privacy Policy, and any Additional Terms (collectively, 'Terms') cover the use and access to the products, services, software, platform and websites (collectively, the 'Services') provided by ITSC GROUP Incorporated and any of our affiliates (collectively, 'ITSC') to you ('user’).
By using our Services, you agree to be bound by these Terms. If you are using our Services as the employee or agent of an organization, you are agreeing to these Terms on behalf of that organization. You must be the legal age of majority in your state of residence or otherwise able to form a binding contract with ITSC in order to use the Services. In no event is the use of Services permitted by those under the age of 18.
In addition to these Terms, your use of specific Services may be governed by additional terms and conditions ('Additional Terms'). If there is any conflict between the Terms of Service and the Additional Terms, then the Additional Terms govern in relation to that Service.

Restrictions of Use
- 1. The User agrees not to use any ITSC Services for any purpose prohibited by all applicable laws. The User also agrees that any Materials, including all information obtained from ITSC-GROUP.COM ('Site'), documentation, and even secondary works created using information from Site or Services (collectively, 'Materials') shown to User when using ITSC Sites or Services will not be shared, disclosed, transmitted, recorded, or permitted to view by unauthorized third parties. However, the results of language tests provided by the Services are not part of the Materials.
- 2. The User agrees not to create any copies of the Site or Services, other than those required for usage on a device to access the Services. The User also agrees not to edit, translate, or create new versions of the Site or Services, or to disassemble, decode, or figure out how any portion of the Site or Services works, unless and only to the extent permitted by law. Finally, the User promises to maintain any copyright and other proprietary rights notices on the Sites or Services, as well as all copies of them, and not to violate anyone else's intellectual property rights.
- 3. The User may be required to register for some ITSC Services. To register for such Services, you must be at least 18 years old.
- 4. The User undertakes not to use another user's account, username, or password at any time, or to do anything else that may threaten the security of your account or the security of another user's account. When appropriate, the User additionally agrees to immediately alert ITSC of any unauthorized or illegal use of your account.
User Content
The User has the option to submit material to the Site and Services ('User Content'). Our relevant Privacy Policy governs User Content. By submitting User Content, you grant ITSC a fully paid up, irrevocable, sub-licensable, worldwide, right to the User Content and represent that you have the necessary rights. Further, the User agrees to indemnify and hold ITSC harmless from all actual and incidental costs and fees associated with ITSC's defense of any claims arising from User Content, including, but not limited to, all attorneys' fees.
Security
- 1. ITSC protects the information you provide with us through our Services with adequate administrative, physical, and technical measures. Despite our attempts to protect your information, ITSC cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to circumvent our protection and improperly gather, access, steal, or change it.
- 2. ITSC recommends that the User installs all appropriate defenses against viruses and malware before downloading any information from Site or using any Services. ITSC will not be held liable for any viruses or malware contracted as a result of using Site or Services and will not be liable for any claim, loss, damage costs or expenses suffered or incurred by any User or person as result of viruses or malware present on Site or within Services.
Term and Termination
ITSC has the right, without notice, to stop, suspend, improve, update, or otherwise alter the Site or Services or their availability to you. When the license to the Site or Services is terminated, the user will stop using all Site and Services.
WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

TSC SITE AND SERVICES ARE PROVIDED BY ITSC ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, UNLESS SPECIFIED IN WRITING. EXCEPT FOR THE WARRANTIES EXPRESSLY STATED IN THESE ITSC TERMS, ITSC MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE SITE OR THE SERVICES, INCLUDING, BUT NOT LIMITED TO, THEIR ACCURACY, QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE ALSO MAKE NO WARRANTY AGAINST INTERRUPTION OR AVAILABILITY OF THE SITE OR SERVICES, NOR THE ENJOYMENT OF THE SITE OR THE SERVICES, NOR AGAINST INFRINGEMENT OF THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS. EXCEPT FOR OUR WILLFUL MISCONDUCT, NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS, AND IN CONSIDERATION OF THE RELATIVE RISKS AND REWARDS, ITSC WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, WHETHER FORESSEABLE, OF ANY KIND ARISING OUT OF OR RELATED TO THESE TERMS, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR LOSS OF BUSINESS, EVEN IF WE ARE AWARE OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING.
OUR TOTAL LIABILITY OF ANY KIND ARISING OUT OF OR RELATED TO THESE TERMS, REGARDLESS OF THE FORUM AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT OF $100.00.

OUR TOTAL LIABILITY OF ANY KIND ARISING OUT OF OR RELATED TO THESE TERMS, REGARDLESS OF THE FORUM AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE TOTAL AMOUNT OF $100.00.
Release and Indemnity
The User agrees to indemnify and hold ITSC and its officers, directors, employees and agents harmless from any claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs and expenses, including reasonable legal fees and expenses, arising out of or in any way connected with (i) your breach or violation of these Terms of Service, (ii) your misuse of the Site or Services, (iii) any damage to or loss of property, arising from or relating to your use of the Site or Services, whether based on warranty, contract, tort, negligence, strict liability or any other legal theory. If requested, the user agrees to appoint ITSC as the User's agent for pursuing and managing any insurance claims arising from the Terms of Service.
Independent Contractor
The User accepts that nothing in these ITSC Terms creates or is assumed to create any franchise, agency, or employer/employee relationship between you, us, or any third-party service providers. The parties are independent contractors and may not bind each other in any way unless the other party expressly agrees in writing.
Notices
ITSC may send you information, including notices of changes to these ITSC Terms, through email, ordinary mail, or posts on the Site. User must notify us through email or normal mail using the information provided in the "Contact Us" section of our website.
Governing Law and Jurisdiction
The use of the ITSC Site and Services is governed by the laws of the State of CALIFORNIA, without regard to conflict of law principles.
Claims; Statute of Limitations
USER AND ITSC AGREE THAT ANY CAUSE OF ACTION ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES MUST BE STARTED WITHIN ONE (1) YEAR OF THE CAUSE OF ACTION OCCURING. OTHERWISE, THE CAUSE OF ACTION IS FOREVER BARRED.

Disabilities
ITSC strives to ensure that our test is impartial and accessible to all. Depending on individual circumstances, accommodations such as extra time, adjusted proctoring, or external aids may be granted. These accommodations are evaluated on a case-by-case basis. If you require accommodations for the test, please complete the form provided. Make sure you obtain approval for your accommodations from ITSC’s Disability Services by submitting your request prior to scheduling your test.
Information related to an individual's diagnosis or medical details will not be disclosed by ITSC unless they have given their informed written consent or it is mandated by legal proceedings. Any information that is released will be done so on a "need-to-know" basis, unless there is a legal requirement to do otherwise. Moreover, to protect the privacy of people with disabilities, assessors may hold back or remove any part of the documentation that is not directly pertinent to ITSC's standards for determining a disability as outlined by the Americans with Disabilities Act (ADA), and a rationale for the requested testing accommodations.
In addition, ITSC recommends that all institutions provide secure storage facilities for confidential and sensitive student and employee information, which could be used to support requests for ITSC accommodations.
